LESSONS OF THE GDS BONUS STRUGGLE :-

                      The Govt. of India had issued the orders for payment of enhanced bonus to all Central Govt. Employees on 29-10-2016.  The bonus calculation ceiling is raised from Rs.3,500/- to Rs.7,000/- from 01-04-2014.  Accordingly the bonus payment to all regular employees for the financial year 2014-15 and 2015-16 was paid with arrears at the enhanced rate of Rs.7,000/- in August 2016.  Unfortunately the Postal Board refused to issue enhanced bonus ceiling in respect of about three lakh Gramin Dak Sevaks working in the Department of Posts.  It referred the case to Gramin Dak Sevaks Committee for recommendations. 
                   The previous GDS Committee headed by Shri Nataraja Murthy had made a retrograde recommendation in its report.  As per that recommendation the productivity of GDS is only 50% of the regular employees and hence it recommended only 50% bonus paid to regular employees to GDS.  At that time the bonus calculation ceiling was Rs.3,500/-.  As per Nataraja Murthy Committee, the GDS are eligible for Rs.1,750/- calculation ceiling only.  Hence the Postal Board refused to extend the enhanced bonus ceiling of Rs.3,500/- for GDS.  Against this stand NFPE and AIPEU-GDS along with Postal Joint Council of Action including FNPO and NUGDS conducted series of agitational programmes including strike.  Postal JCA discussed the case with the then Minister of Communications also.  Finance Ministry rejected the case for enhancement of bonus to 3,500/- three times inspite of favourable recommendations from Minister, Communications. Finally, after prolonged struggle the Finance Ministry  approved the enhancement and orders for grant of bonus at the rate of Rs.3,500/- was issued for Gramin Dak Sevaks also. 
                   This time, the Chairman of the GDS Committee, Shri Kamalesh Chandra, took a different stand.  The Committee recommended the enhanced bonus of Rs.7,000/- to GDS also.  It stated that the overall revenue generated by GDS Post offices and the overall expenditure for running the GDS Post offices is almost equal.  The actual deficit on account of GDS is only 200 crores, whereas the total deficit of Postal department is more than 6000 crors.  That means the loss on account of GDS is very meagre when compared to the loss incurred for running the departmental post offices, RMS and Administrative Offices.  Hence, Shri Kamalesh Chandra Committee made a favourable recommendation to Postal Board to grant enhanced bonus to GDS at the rate of Rs.7,000/-.  Postal Board sent the file to Finance Ministry for approval.  The Finance Ministry after detailed study, gave approval and Department of Posts issued orders on 27-10-2016.
Role played by NFPE & AIPEU - GDS:
                   NFPE and AIPEU-GDS under the leadership of Com.R.N.Parashar, Secretary General, NFPE and Com. P.Panduranga Rao, General Secretary, AIPEU-GDS, gave call for agitational programmes along with FNPO & NUGDS, protesting against the discrimination shown towards GDS and demanding enhanced bonus calculation ceiling of Rs.7,000/- to GDS also for the financial year 2014-15 and 2015-16 also demanding payment of revised wages to all casual, part-time, contingent employees from 01-01-2006.  It conducted nationwide protest demonstrations and mass dharna in front of all Circle/Regional and Divisional Offices.  It declared indefinite hunger fast in front of Postal Directorate (Dak Bhavan, New Delhi) from 3rd November 2016 and two days strike on 9th &10th November, 2016.  Notice for the two days strike was served to the Secretary, Department of Posts on 20-10-2016.  Intensive campaign was undertaken throughout the country and the response from employees was overwhelming.
Departmental Employees and GDS unity is exhibited:
                   In 1984, first time in the history of Postal Trade Union movement the Postmen,Group D & EDAs Union (NFPE) under the leadership of late Com. Adinarayana, the legendary leader, gave a call for nation-wide one day strike on 19th September 1984 exclusively for one demand ie; the demand of the Extra Departmental employees.  Again after 32 years NFPE & AIPEU-GDS along with FNPO & NUGDS took a historic decision to go for two days nation- wide strike on 2016 November 9th & 10th, both by departmental employees and Gramin Dak Sevaks, exclusively for the demands of most down-trodden section of GDS and Casual Labourers.  No other demand of departmental employees was added to the charter of demands.  We proved that NFPE, AIPEU-GDS and Postal JCA always stood with the GDS and Casual Labourers and the departmental employees declared that GDS and Casual Labourers are our own family members and we will not tolerate any discrimination and shall go for  two days strike for GDS and Casual Labourers.  This is really an inspiring experience. 
Role of recognised GDS Union:
                   The recognised GDS Union of Shri S.S.Mahadevaiah, earlier used to declare that I will go for indefinite strike only as no purpose will be served by one day or two days strike.  He has written many write-ups and circulars earlier criticising NFPE & AIPEU-GDS for one day or two day’s strike.  The same leader, who earlier said that I don’t believe in one day or two days strike, this time was afraid of the NDA Government and decided to go for two days strike on 25th & 26th October 2016.  He has not made any campaign other than giving strike notice.  His list of new office bearers elected in the belated last  All India Conference was pending before the Directorate for approval. He was afraid of loosing recognition, if he goes on strike.  The Department of Posts has clearly informed him about the consequences of the strike.  After discussion with Department he surrendered and agreed to withdraw the strike and his strike call was withdrawn on 24-10-2016 itself, even before the approval of the Finance Ministry.  The leader who used to criticise others for deferring the strike earlier, has ran away from the battle field half way, fearing withdrawal of recognition.  Thus the real face of the recognised union leader was exposed before the entire postal employees.  NFPE has already reminded him earlier itself that- '' you can make fools some GDS for sometimes but cannot make fool all GDS for all time”.  Sri Mahadevaiah is afraid of facing membership verification also and is requesting  the department every time for extension.
NFPE, AIPEU-GDS and PJCA stand-
        Departmental held discussion with NFPE, AIPEU-GDS, FNPO& NUGDS.  They have also cautioned the leaders on the consequences of the strike.  But, unlike Shri Mahadevaiah who ran away from battle field fearing de-recognition NFPE, AIPEU-GDS and PJCA took a  bold stand and declared that we will not  withdraw the strike unless and until orders for payment of enhanced bonus is issued by Department and we are ready to face any victimisation.  It also demanded issuing of instructions regarding casual labourer wages.  Finally department issued GDS bonus orders on 27-10-2016.  It has already issued orders for payment of Casual Labour wages from 01-01-2006 and agreed to issue strict instructions to all Chief PMGs for implementation.
GDS Committee and role of NFPE & AIPEU-GDS
        Government has appointed a separate GDS committee under the Chairmanship  of Retired Postal Board Member Shri Kamlesh Chandra.  Our demand for inclusion of GDS also under the purview of 7th CPC was not accepted by the NDA Government  NFPE and AIPEU-GDS has submitted a detailed memorandum to GDS Committee.  A delegation of NFPE and AIPEU-GDS has met the Chairman, GDS Committee three times and tendered oral evidence.  Our main demand is grant of Civil Servant Status and grant of all benefits of departmental employees to GDS.  The GDS Committee has  informed that it will submit it’s  recommendations to Government in November 2016 .  If the recommendations are against the interest of the GDS, NFPE & AIPEU-GDS will definitely go for struggle including strike along with postal JCA. 
        The recognised GDS Union of Shri Mahadevaiah could  not settle any of the demands  of GDS during the last more than 15 years.  He don’t believe in the unity of GDS and departmental employees.  He is treating the departmental employees and their recognised federations ( NFPE & FNPO) as the enemy of GDS.  He is also against the united movement of Central Government Employees and Confederation of Central Government Employees and workers.
                   In the above circumstances it is the duty of every GDS employee to strengthen NFPE and APIEU-GDS.  It is proved that only a United Struggle of departmental employees and GDS can settle the genuine demands of GDS employees.  Realising this fact, all the GDS are requested to vote for AIPEU-GDS, by submitting the authorisation letters (declaration forms) in favour of AIPEU-GDS, which is an Associate Member of NFPE, in the coming membership verification. 
Role of Confederation and JCM (National Council) Staff Side:
                   The Confederation of Central Govt. Employees & Workers extended full support and solidarity to the strike call of NFPE, AIPEU-GDS and Postal JCA for enhancement of bonus ceiling to 7000 and called upon all other Central Govt. employees  (other than Postal employees) to conduct solidarity demonstrations on the days of the two day strike on 9th &10th November 2016.  The Confederation took initiative to raise the issue in the JCM (NC) Standing Committee meeting held on 25-10-2016 along with the JCM staff side.  The GDS Bonus issue was discussed in the JCM with Govt. and demanded immediate settlement. 
Congratulations and Salute to All:
                   No doubt, the GDS bonus ceiling enhancement is as great victory for NFPE, AIPEU-GDS and Postal JCA including FNPO and NUGDS.  The departmental employees and GDS who unitedly conducted the struggle till victory, deserves congratulations.  The unity of departmental employees and Gramin Dak Sevaks should be further strengthened and those who are trying to break the unity should be isolated.  Coming days are very crucial and may demands more united and militant struggles.  Let us once again declare that “Unity is for struggle and struggle for Unity”.

               Sub:  An Appeal for participation in the agitational programmes of confederation for realisation of 20 point charter of demands.
               As  yoy are aware, the general attitude of the Central Government towards the demands of the Central Government  employees, especially demands related to 7th Central pay Commission, is totally negative.  Even the  assurance given by  three group of Ministers in the wake of an impending indefinite strike from July 11th 2016, that the minimum pay and fitment formula will be revised, is not yet implemented, eventhough the  promised time frame of four months are almost over.  All the revised allowances including HRA and Transport Allowance is not paid yet.  The one and the only favourable recommendation of 7th CPC ie; option -I party for pensioners is not accepted on the plea of '' non-feasibility''.  All anomalies are pending.  Government is deliberately dealying  and denying the legitimate benefits of the Central Government employees   which is due   from 01-01-2016.  You may agree that the position is equally applicable to Gazetted officers also.
               In the above circumstances/the National Secretariat of /confederation of Central Government employees and workers has decided to organise phased  agitational programes culminating in strike action.  Demonistrations are conducted in front of all offices on 20-10-2016, next phase is mass dharna at all important centres on 7th November 2016, Third phase is massive Parliament March on 15th December 2016.
        I request you to consider the above stituation and also the programmes of action of Confederation and to call upon your affiliates to participate in the Parliament March on 15th December 2016 under the banner of CCGGOO, in good number

Dear Friends and Comrades,
                   As you are aware, the extension of benefits of revised pay structure as per CCS (RP) Rules 2016, to employees working in autonomous bodies, is still pending.  There is total uncertainty regarding grant of 7th CPC benefits.  Bonus payment is also pending. Everything depends upon the policy decision of the Government.  The employees of autonomous bodies are totally upset, frustrated and disappointed.  Discontentment of the employees are growing day by day.  As the autonomous bodies are scattered all over the country, a joint struggle by them alone is not an immediate possibility.
                   It is in this background, the Confederation of Central Govt. Employees & Workers has decided to include the demand for wage revision of autonomous employees also in its charter of demands and agitational programmes.  Accordingly mass demonstrations were conducted in front of all offices on 20-10-2016.  The next phase of programme is mass dharna on 7th November 2016.  Third phase is massive Parliament March on 15th December 2016 at Jantar Mantar (Parliament Street), New Delhi.
                   I request all the organisations and employees of autonomous bodies to join the Confederation’s agitational programme so that Government will understand your anger, protest and discontentment.  I appeal to you all, to participate in the Parliament March on 15th December 2016, with your flags, banners and placards.  Let the message go to the Government that the employees of autonomous bodies will not continue to keep silent and may be forced to go for direct action, including strike if situation warrants, for their legitimate demands.
                   Come one, Come all, Come in hundreds and thousands.
                   Let us make the Parliament March a historic success.

LANDMARK JUDGMENT BY SUPREME COURT FOR PAYMENT OF “EQUAL PAY FOR EQUAL WORK” TO THE DAILY WAGE EMPLOYEES, ADHOC APPOINTEES, EMPLOYEES APPOINTED ON CASUAL BASIS, CONTRACTUAL EMPLOYEES AND THE LIKE.

                 The Hon’ble Supreme Court in its Historical 102 pages Judgment in Civil Appeal No. 2013 of 2013 dated 26.10.2016 has directed that Temporary Employees, Adhoc Appointees, employees appointed on Casual basis, contractual employees and the like, if the concerned employees are rendering similar duties and responsibilities as were being discharged by regular employees holding the same/corresponding posts are entitled “for equal pay for equal work” such employees are entitled for draw wages at the minimum of the payscale extended to regular employees holding the same posts. We will be representing to the Govt. To implement this Judgment and issue a common order in this regard. Full judgement is reproduced below:

CONFEDERATION & JCM STAFF SIDE EXTENDED FULL SUPPORT AND DISCUSSED THE CASE IN THE JCM STANDING COMMITTEE MEETING WITH THE GOVERNMENT ON 25.10.2016..

CABINET APPROVES RELEASE OF AN INSTALMENT OF DEARNESS ALLOWANCE TO CENTRAL GOVERNMENT EMPLOYEES AND DEARNESS RELIEF TO PENSIONERS DUE FROM 01.07.2016

   The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has given its approval to release an instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to Pensioners w.e.f. 01.07.2016 representing an increase of 2% of the revised Basic Pay/Pension, to compensate for price rise. The increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.

            The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be Rs. 5622.10 crore per annum and in the Financial Year 2016-17 for the period of 8 months (i.e. from July 2016 to February 2017), it would be Rs.3748.06 crore. About 50.68 lakh Government employees and 54.24 lakh pensioners will be benefited.

கடந்த 2012 ஆம் ஆண்டு தமிழகம் வருகை புரிந்த பாராளுமன்ற நிலைக் குழுவுக்கு அளித்த எழுத்து பூர்வமான  ஒப்புதலை மீறி , இருக்கும் ஊழியர்களை வைத்தே எல்லா ஞாயிறு மற்றும் பண்டிகை விடுமுறை தினங்களிலும், பன்னாட்டு கம்பெனிகளின் பொருட்களை பட்டுவாடா செய்திடவும் , விரைவுத் தபால்களை பட்டுவாடா  செய்திடவும் இலாக்கா உத்திரவிட்டு,நாடு முழுவதும் கடந்த 23.10.2016 உடன் தொடர்ந்து ஐந்தாவது விடுமுறை தினமாக இந்த பட்டுவாடா நிகழ்வு தொடர்கிறது. இதனை தமிழக அஞ்சல் மூன்று சங்கம் தொடர்ந்து எதிர்த்து வருவது உங்களுக்குத் தெரியும். முதல் எதிர்ப்பை பதிவு செய்ததும் உங்களுக்குத் தெரியும்.

ஏற்கனவே கடந்த 13.10.2016 இல் தெளிவான கடிதத்தை நம்முடைய CPMG க்கு அளித்துப் பேசினோம் , இது இலாக்கா உத்திரவு என்று மாநில நிர்வாகம் கூறியதால் , உடன் நம்முடைய சம்மேளன மாபொதுச் செயலருக்கு இந்தப் பிரச்சினையைக் கொண்டு சென்றோம். அவரும் இலாகாவுக்கு கடிதம் எழுதியுள்ளார். 

இருப்பினும் பிரச்சினை தீரவில்லை. பன்னாட்டு கம்பெனிகளில் கூட அங்கு பணிபுரியும் ஊழியர்களுக்கு  சனி , ஞாயிறு விடுமுறை அளிக்கப்படுகிறது. கூரியர் நிறுவனங்கள் கூட  அமேசான், நாப்தால் பொருட்களை ஞாயிறு மற்றும் பண்டிகை தினங்களில் பட்டுவாடா செய்வதில்லை . அங்கெல்லாம் தொழிலாளர் நலச்  சட்டங்களுக்கு மதிப்பளித்து வார விடுமுறை அளிக்கிறார்கள். 

ஆனால் MODEL EMPLOYER என்று அரசியல் அமைப்புச் சட்டத்தில் சொல்லப்படும் மத்திய அரசுத் துறையான அஞ்சல் துறை அதிகாரிகள், தன்னுடைய இலாகாவில் பணி  புரியும் ஊழியர்களை கொத்தடிமையாக நினைத்து  வார விடுமுறை மற்றும் பண்டிகை தினங்களில் பணிக்கு வரச்சொல்லி  உத்திரவு இடுகிறார்கள். கேட்டால் ரயில்வே துறையில் 24 மணிநேர  பணி  செய்யவில்லையா ? அங்கெல்லாம் ஞாயிறு விடுமுறை விடப்படுகிறதா என்று விபரம் தெரியாமல் சில கீழ்மட்ட அதிகாரிகளும் கேட்கிறார்கள். 

ரயில்வேயில் பணி  புரியும் ஊழியர்களின்  பணித்தன்மை , அங்குள்ள ஊழியர் எண்ணிக்கை, அவர்கள்  ஒரு நாள் பணி  செய்தால் ஒன்று விட்டு  மறுநாள் அவர்கள் பணிக்கு வந்தால் போதும் என்ற விபரமெல்லாம் கூட அவர்களுக்குத் தெரியவில்லை. 

இங்கேயும், மூன்று மடங்கு ஊழியர்கள் பணி  நியமனம் செய்யப்பட்டு, அவர்களுக்கு  24 X 7 பணிக்கான அனைத்து சலுகைகளும் வழங்கப்பட்டு, பணி நியமன  சட்டத்தில் 3 X 8 தன்மை உண்டு என்று சட்ட ரீதியாக அறிவிக்கப்பட்டு ஆளெடுக்கப்பட்டால்  இதனை தாராளமாக இங்கு அமல்படுத்தலாம். 

3 SHIFT களில் ஊழியர்களை பணிக்கு கொண்டு வரலாம். இதுவெல்லாம் தெரியாமல், 'சட்டிக்குள்  பானையை கழுவுவது போல'  இருக்கும் குறைந்த மனித சக்தியை 365 நாட்களுக்கும் பயன்படுத்த வேண்டும் என்று எண்ணுவது முற்றிலும்  மனித உரிமை மீறலாகும். அல்லது எதேச்சாதிகாரமாகும்.

இது குறித்து நமது மாநிலச்  சங்கம் அளித்த கடிதத்தின் உண்மையை ஏற்றுக் கொண்ட நமது CPMG  அவர்கள், MEMBER ( O ) விற்கு நேரடிக் கடிதம் எழுதி அத்துடன்  பாராளுமன்ற நிலைக்கு குழுவுக்கு இலாக்கா அளித்த பதிலின் நகலையும் இணைத்து , முடிவை மறுபரிசீலனை செய்திடலாம் என்று பரிந்துரைத்துள்ளதாக  நம்முடைய மாநிலச் செயலரிடம்  PMG  MM அவர்கள் இன்று தெரிவித்தார்கள்.  

மேலும் இது இலாக்கா முதல்வரால் அளிக்கப்பட்ட உத்திரவு என்பதால், ஒட்டுமொத்தமாக தங்களால் இதனை ரத்து செய்திட இயலாது எனவும் , CPMG அவர்களுடன் கலந்து பேசி எதிர்வரும் தீபாவளி பண்டிகை தினங்களுக்கு மட்டும் தமிழகத்தில் இதனை ரத்து செய்திட பரிசீலிக்கிறோம் என்ற உறுதியை அளித்துள்ளார்கள் . 

CPMG  அவர்கள் கேரளா அஞ்சல் வட்ட பொறுப்பும் ஏற்றுள்ளதால் அவர் எதிர்வரும் 27.10.2016 மாலைக்கு பிறகுதான் வர இயலும் எனவும், எனவே எதிர்வரும் 28.10.16 அன்று காலை அவரை சந்திக்கலாம் என்றும் தெரிவித்தார்கள். மேலும் உடன் இது குறித்து பேசிட PMG ,MM  மற்றும் DPS, HQ ஆகிய இருவரையும்  CPMG  அவர்கள் பணித்துள்ளதால், நாளை 26.10.2016 காலை 10.30 மணிக்கு PJCA  பிரதிநிதிகளை அழைத்துள்ளார்கள். இதில் தீபாவளி பட்டுவாடா நிறுத்தம்  குறித்து முடிவு அறிவிக்கப்படும். இதனிடையே, தென்மண்டல மற்றும் கோவை மண்டல பொறுப்பேற்றுள்ள PMG அவர்கள் தன்னுடைய மண்டலங்களில் தீபாவளி பட்டுவாடாவை  நிறுத்திட உத்திரவை அளித்துள்ளார்கள். அவர்களுக்கு நம் நன்றி .

மேலும் இது குறித்து இன்று இரண்டுமுறை நம்முடைய சம்மேளன மாபொதுச் செயலருக்கு நம்முடைய மாநிலச் செயலர்  தகவல்களைத் தெரிவித்து தமிழகத்தில்  PJCA  போராட்ட களம்  அமைந்துள்ளதால் உடன் அஞ்சல் வாரிய உறுப்பினர் ( O ) அவர்களை சந்தித்து முடிவு காண வேண்டியுள்ளார். அவரும் உடன் சந்தித்து பிரச்சினையை பேசுவதாக நம்முடைய மாநிலச் செயலருக்கு உறுதி அளித்துள்ளார்.

         1.            Amendment to the definition of anomaly as notified by Government in the orders of constitution of anomaly committees at various level.

The DOPT&T has notified the definition of anomaly arising from the 7th CPC recommendation vide their OM No. 11/2/2016-JCA dated 16th August 2016 as under:

“(1) Definition of Anomaly
Anomaly will include the following cases

(a) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle of the policy enunciated by the 7th Central Pay Commission itself without the Commission assigning any reason, and

(b) Where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Band Band under the pre-revised structure as notified vide CCS (RP) Rules 2016 is less than the amount an employee is entitled to be fixed at as per the formula for fixation of pay contained in the said Rules”

The Anomaly normally arises due to the recommendation of the Pay Commission having been acted upon without going into the ramification of such action on similarly placed employees in various other organisations.

In this connection, we may refer to the OM No. 19/97-JCA, DOP&T, dated the February 6, 1998 where the anomaly was defined as under, on reaching an agreement between the Staff Side and the Group of Ministers on 11.9.1997.

“(1) Definition of Anomaly

         Anomaly will include the following cases:

(a) Where the Official Side and the Staff Side are of the opinion that the vertical/horizontal relativities have been disturbed as a result of the Fifth Central Pay Commission Report in a manner leading to grave dissatisfaction and adverse impact on efficiency;

(b) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle of the policy enunciated by the 7th Central Pay Commission itself without the Commission assigning any reason, and

(c)  Where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Band Band under the pre-revised structure as notified vide CCS (RP) Rules 2016 is less than the amount an employee is entitled to be fixed at as per the formula for fixation of pay contained in the said Rule

(d) Where the amount of revised allowance is less than the existing rate”.

We request that the definition of anomaly may be replaced with what is stated in the OM dated February 6, 1998.

         2.           Withdraw the stringent conditions unilaterally imposed by Government for grant of Modified Assured Career Progression (MACP) promotion and grant MACP on promotional hierarchy. Personnel promoted on the basis of examination should be treated as fresh entrant to the cadre for grant of MACP. The pre-appointment induction training period may be counted as regular service for grant of MACP as it is counted for increment.

It was in the background of extreme stagnation, especially in the lower cadres, the 5th CPC was approached for a promotional scheme which must not be linked with vacancies but on time bound basis. The 5th CPC in appreciation of the genuine aspirations of the low paid employees as also taking into account the practice followed in Government services of cetain State Govts introduced the ACP scheme assuring minimum two financial upgradations (promotions) in the service career of a person. The ACP, as is known when granted, does not make the incumbent to function in a post with higher responsibility but continue to be in same cadre/grade but with higher remuneration.

The 6th CPC did not make any great deviation of the scheme. But the Govt., acceding to the demand of the Staff Side, improved the 2 time-bound promotions as 3 promotions under the MACP scheme. However, while issuing the orders the scheme was made applicable, unlike ACP, only Grade Pay based financial upgradation as recommended by the 6th CPC. Between 2006-11, the Staff Side had pointed out on innumerable occasions, the anomalies the said decision created and having obtained no redressal the employees were driven to courts, whose decisions were not allowed to be given effect to.

The 7th CPC recommendations gave the impression that it has appreciated the concern of Staff Side and had suggested for a cadre hierarchy based MACP scheme. The order issued by the DOPT on 27.9.2016 belies that in as much as it is stated in Para 3.2 as under: 

“The MACPS envisages merely placement in the immediate next higher level in the Pay Matrix as given in Part A of Schedule of the CCS (Revised Pay) Rules, 2016. Thus the level in the Pay Matrix at the time of financial upgradation under the MACPS can, in certain cases where regular promotion is not between two successive levels in the Pay Matrix, be different than what is available at the time of regular promotion. In such cases, the higher level in the Pay Matrix attached to the next promotion post in the hierarchy of the convened cadre/organisation will be given only at the time of regular promotion”.

Besides, the Govt. has accepted the recommendation of 7th CPC in Para 5.1.45 making Bench-mark of ‘very good’ as the primary criterion for MACP.

We request that the order making MACP level bases hierarchy instead of cadre based hierarchy must be rescinded as the changed scheme has been less beneficial to large number of employees compared to ACP and it has given rise to anomalies in Pay between two schemes of employees in the same cadre.

Secondly, the stipulation of Benchmark “Very Good” for MACP is untenable and the MACP is only financial upgradation and does not devolve any additional responsibility and the individual concerned continues to function in the same grade and cadre even after grant of MACP. It may also be noted that “Very Good” is not a bench mark even today for promotion in Gr B and C cadres. 

When the intention is only financial upgradation in view of the long number of years one has put in, the stipulation of Bench March “Very Good” is wrong and deserves to be withdrawn.

Two other issues requiring consideration and acceptable are:

(1) The personnel promoted to a cadre bases on examination must be treated as new direct entrant to that cadre and MACP to be related with the date of entry to that cadre;
(2) The pre-appointment induction training period is to be counted as regular service period for the purpose of MACP.

          3.           Removal of ambiguity in fixation of pay of re-employed Ex-Servicemen and grant of the same benefit extended to Commissioned officers to personnel Below officers Rank also.

The pay fixation of re-employed Ex-Service men who held the rank below commissioned officers/Group A at the time of their re-employment is not carried out in many departments as per Government orders on the subject issued from time to time due to misinterpretation/wrong clarification by the administrative authorities. The re-employed Ex-service men personnel below the officers Rank are being deprived the minimum pay of the post from which they are retired from Army, instead their pay is fixed at the minimum of the re-employed post only, whereas those who retired as commissioned officers/Group A is extended differential treatment and their pay is fixed at a higher stage due to their past service benefit. Fresh orders/amendments be issued free from any scope for misinterpretation/ambiguity, clearly mentioning the fixation of pay of the re-employed Ex-Service men belonging to below officer rank, at the same stage as the last pay drawn before retirement from army, ignoring the entire portion of pension since the pension is minuscule and not even enough to lead a decent living.

4.   Permission to opt for pay fixation in the Revised pay structure on a date after the date of issue of CCS (RP) Rules 2016 notification (25.07.2016) in case of employees whose promotion become due after 25.07.2006.

As per the clarification issued by Department of Expenditure (Implementation cell) on 29th September 2016, in case and employee is promoted or upgraded to the higher pay structure (in the pre-revised pay structure) he may be permitted to exercise revised option as per FR 22 (i) (a) (i) to have his pay fixed under the Revised Pay Rules 2016, from the date of such promotion/upgradation or from the date of next increment. As per this rule and employee who is promoted/upgraded on 24.07.2016 (one day before the date of issue of notification) can opt for fixation of his revised pay on the date of next increment which falls on 01.07.2017. This facility is available only for those employees who are promoted before 25.07.2016 (date of notification of CCS (RP) Rules 2016). If an employee is due for promotion on 26.07.2016 (one day after the date of notification) he cannot opt to fix his revised pay under the CCS (RP) Rules 2016 on the date of next increment i.e. 01.07.2017. This is a clear case of discrimination and amounts to creation of a class within a class. Hence the option for fixation of pay under CCS (RP) Rules 2016 from the date of next increment, may be extended to the employees who are due for promotion after the date of issue of notification i.e. 25.07.2016 also.

5.   Extension of the benefit of bonus calculation ceiling enhancement to Rs. 7000/- to Gramin Dak Sevaks (GDS) of the Postal department also.

The above benefit is yet to be granted to the GraminDakSevaks for want of approval of the Finance Ministry. The GDS Committee constituted to revise the wages and service conditions of GDS has already recommended to grant enhanced ceiling of Rs. 7,000/- to GDS also and their suggestion is pending with the Govt. for action. We request that orders enhancing the ceiling limit to RS 7,000/- may be issued immediately.

6.   Regularise the services of casual labourers by absorbing them against vacant posts of MTS as one time measure.

Casual and contingent workers were engaged by various Departments to cope up the regular work especially in the period when the Ban on Recruitment/creation of posts was in operation. Such appointments had become necessary to ensure that the work does not suffer and the public at large are not put to difficulties. There had been despite the directive issued by DOPT in the past banning such engagement of casual labour. Over the years their number has increased manifold. These employees have put in several years of service. The omnibus order banning he recruitment does not spell out as to how the work assigned especially in operational and public dealing departments are to be carried out. Presently due to either delay on the part of the recruiting agency or for such unforeseen reasons in various departments, MTS posts are lying vacant and contract workers are engaged. The case of those who were employed against vacancies of permanent and perennial nature of jobs for regularization cannot be denied except in violation of the existing labour laws or on unethical ground. To address this, the DOPT must draw up a scheme for regularization of eligible candidates in Government service as a onetime measure.

7.       Fill up all vacant posts including promotional posts in a time bound manner

Inspite of lifting of ban on filling up of vacant posts from 2010 onwards, in many departments posts are not being filled and an undeclared ban is in existence. The 7th CPC has stated that there are about six lakhs vacant posts in central services. Non-filling up of vacant posts has adversely affected the efficiency of many departments. Further many promotions posts are lying vacant due to abnormal delay in convening DPCs. Strict instructions may be issued to all departments to initiate action to fill up all vacant posts on top priority basis and also to convene the DPCs regularly for granting promotion to eligible officials.

8.       Abolish and upgrade all posts of Lower Division clerks (LDCs) to Upper Division Clerks (UDCs).

The cadre of Lower Division Clerks in Govt of India service has now become redundant as many of the jobs assigned to them are part of the duty list of MTS and the rest is also assigned to UDCs. The abolition of Gr. D cadres and introduction of MTS with certain clerical functions and computerised functioning in all organisations of GOI have made the cadre presently superfluous. As pointed out, the UDCs whose educational qualification is Graduation has overlapping functions of LDCs. Major Deptt. of the Govt of India recognising this fact has reduced the cadre strength of LDCs. We therefore request that the existing No. of LDC posts in Government may be upgraded as one time measure as UDCs and the posts of LDCs totally abolished.
